Forces Of Metal Festival, Netherlands Fails To Fulfill Contractual Obligations - MANOWAR Performance Canceled!
Following the festival organizer's failure to meet their contractual obligations, making MANOWAR's headlining performance at Forces Of Metal Festival on June 8th 2012 impossible, the band's performance is officially canceled.
Magic Circle Management have done everything in their power to save this performance for the sake of the fans, but the organizers have failed to find a solution to all of their problems and Magic Circle Management must protect the MANOWAR fans.
The band was looking forward to returning to Holland with next year's massive festival production. Magic Circle management hope that Forces Of Metal will immediately refund all tickets sold to all those who purchased a ticket to see MANOWAR.
Those who have purchased tickets to Forces Of Metal, Netherlands to see MANOWAR are urged to immediately contact the promoter's office to obtain a full refund.
Antwort von Forces of Metal:
Finally we are able to answer your mails back.
We will respond on your first email, dated on the 3rd of january 2012.
We have seen the posts many Manowar fans have posted on Forces of Metal facebook. Some of them cannot be tolerated!
Ofcourse all in reaction of the statement that Manowar has given on the 15th of december 2011.
Especially where they stated to contact us for a full refund!
We, as legal advisors of the organisation, can tell you that when Manowar posted this statement, that it came out of no where.
Without any notification prior to this statement from their part
(management) Forces of Metal festival were not notified that this would happen.
It is true that Manowar and the organisation had some difficulties, but that should not have been a reason to not perform. That could have been prevented.
Forces of metal Entertainment didnt know how to respond to this situation at first, cause it was simply overwelming and surprising to them.
We also adviced them to see if there was still a solution possible, but Mr. Joey deMaio (who claims not to be the head of the management) didnt want to make a solution anymore.
The difficulties that Forces of Metal had with them was that Forces of Metal stood up for themselves when financially everything went higher then originally was agreed on. Manowar wanted to record a DVD like Earthshaker, but the organisation had to pay for the production!
The organisation wanted even to forfill even those extra costs but all we asked was some extra time to do as Manowar wanted and wished for.
They still had so many months left....
Time was not given to them. Instead of that they was given the boot.
Forces of Metal allready had payed a part for Manowar.
So for them to say, to get a full refund is not fair since they have taken a big part of the costs allready. They should have informed us prior to all of this, so that the money that should have went to the ticketbuyers....shouldnt had gone to Manowar.
It was Manowar who cancelled on their own, not Forces of Metal!
We are now a month further and still we are in the negative news.
Also because Manowar's Mr. Joey deMaio has written all managements of the bands on our bill to not play at our festival. Why would a band go that far when all Forces of Metal organisation did was to find a solution??
They are besides an organisation also musiclovers and they go themselves also to festivals, so they understand that fans are pissed.
(A story has always 2 sides)
As we said before...we are now a month further and trying to pick up the pieces.
We have read into the contract and to the terms and conditions.
You allready have seen our terms and conditions and you know what they mean, but Forces of Metal organisation are working on a solution when it comes to a perhaps refund. The reason why we are working on that now is that we have tried for 3 weeks to come to a solution with the management of Manowar.
This failed! Manowar wont perform.
Manowar fans have to give us the time to see what we can do, cause we also believe that whatever they come up with as a solution will never be good enough.
Manowar fans must understand the contractwise they are not obligated to do so, since Manowar cancelled on their own their performance!
We and the organisation have to look into this matter first legaly since our terms and conditations states clearly we are not obligated to do so when a band pulls themself back!
This takes time but we are working on it.
We know that this is hard to believe but we do!
There are people in this organisation who wants this festival to succeed and make it an annual festival, a start like this is not good and therefor and only therefor we want to make a statement that Forces of Metal will go in the books as a fairplay festival for the Manowar fans.
We hope you understand this message and we will bring you news on this matter as soon as we know what our possibilities are.
With deepest respect,
Forces of Metal Entertainment
